DMCA Policy
Analyst Nvidia Target respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to notices of alleged copyright infringement that are reported to our designated Copyright Agent, provided such notices substantially comply with the requirements of the DMCA.
This policy outlines the information required to submit a DMCA notice to Analyst Nvidia Target and the process for responding to such notices, including the counter-notification process.
Filing a DMCA Notice of Infringement
If you believe that your copyrighted work has been copied and is accessible on the Analyst Nvidia Target website in a way that constitutes copyright infringement, you may notify our Copyright Agent by providing the following information in writing (see 17 U.S.C. Section 512(c)(3) for further detail):
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
- Identification of the material that is claimed to be infringing and where it is located on the Analyst Nvidia Target website, including a URL or other pertinent information that will allow us to locate the material.
- Your contact information, including your address, telephone number, and email address.
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
DMCA Counter-Notification Procedure
If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Copyright Agent. Pursuant to Sections 512(g)(2) and (3) of the DMCA, a counter-notification must include the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside of the United States, that you consent to the jurisdiction of the United States District Court for the [Specify District, e.g., Northern District of California]), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Please note that Analyst Nvidia Target will forward the full counter-notification to the original complaining party. The complaining party will then have 10 business days to inform us that they have filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on Analyst Nvidia Target. If we do not receive such notification within 10 business days, we may reinstate the removed material.
